GENERAL TERMS AND CONDITIONS FOR WORKING WITH CUSTOMERS OF FIESTA TRAVEL Ltd.

  1. General provisions. Fiesta Travel Ltd. is a travel agent that offers and maintains tourist, information, communication and reservation systems for tourist services on the Internet, which contain offers, information and services related to travel. Fiesta-fly.com is a franchise brand of Fiesta Travel Ltd.. For matters not covered by the contractual relationship between Fiesta Travel Ltd. and the customer, these General Terms and Conditions for Working with Customers shall apply. Different or additional General Terms and Conditions shall only be applicable after express written confirmation by Fiesta Travel Ltd.. The following general terms and conditions for working with customers govern the use of the Fiesta-fly.com portal, owned by Fiesta Travel Ltd..

     

  2. Terms and conditions for booking tourist services through Fiesta-fly.com.
    1. Services offered by Fiesta Travel Ltd. through the Fiesta-fly.com portal. The tourist and transport services offered by Fiesta Travel Ltd. through the Fiesta-fly.com portal are intermediary services, provided on behalf of, for the account of and at the request of the respective tour operator and/or service provider. The provision of tourist and transport services is not included in the range of services provided through Fiesta-fly.com. Unless otherwise agreed between Fiesta Travel Ltd. and the customer, the contract relating to accommodation, travel or transport is concluded between the customer and the relevant service provider (e.g. tour operator, hotel, airline, etc.), taking into account the valid terms and conditions. These are announced before a reservation is made and must be confirmed by you. If there is no such confirmation, the reservation cannot be made.
    2. Contents of the intermediary contract.Upon completion of the booking process after filling in the form fields, you instruct Fiesta Travel Ltd. through Fiesta-fly.com to act as an intermediary for a tourist, transport or other similar service, as well as for a service related to the performance of a trip provided by a third party. If the customer places an order for the mediation of more services, these remain legally separate and do not form a single package of tourist services. Fiesta Travel Ltd. remains in any case only an intermediary and does not assume the role of a tour operator. With your booking order, you are bound from the moment of its submission. Fiesta Travel Ltd., through Fiesta-fly.com, reserves the right to accept or refuse this order. Acceptance or refusal of a reservation by Fiesta Travel Ltd. shall be confirmed within one week - in writing, by telephone, e-mail or fax. Your order shall be deemed accepted by Fiesta Travel Ltd. in any case upon charging your credit card or upon presentation of an invoice by Fiesta Travel Ltd. or the relevant service provider. By accepting your order in the manner specified, a binding agency contract is concluded between the travel agent and the customer.You are obliged to check the booking confirmation immediately for accuracy and to notify Fiesta Travel Ltd. or the relevant service provider with whom the booking was made of any errors. Late notification of errors or inaccuracies cannot be taken into account and does not entitle you to withdraw from the contract. The contractual obligation of Fiesta Travel Ltd. through Fiesta-fly.com is limited to the mediation of the booked trip or tourist service. The provision of the booked service as such is not part of the contractual obligations of Fiesta Travel Ltd..
    3. Execution of your booking. /Compensation/Payment/. Delivery of travel documents. • Online booking The mediation of tourist or transport services by Fiesta Travel Ltd. through Fiesta-fly.com is free of charge, insofar as it does not relate to the mediation of airline flights. For the mediation of flights, Fiesta Travel Ltd. through Fiesta-fly.com reserves the right to charge a separate service fee. The respective amount in each case is indicated in the booking menu before requesting personal data and before requesting a binding booking enquiry. By virtue of this, you declare that you voluntarily provide the personal data necessary for making the reservation and performing the service. The form of payment for travel or transport services booked through Fiesta-fly.com is determined in accordance with the agreements with the respective tour operator or service provider. The possible payment methods will be communicated to you at the time of booking. Depending on the date of travel, payment by credit card, bank transfer or cash is possible.If, between the time of booking and the start of your trip, you change your credit institution or other credit card details, you are obliged to inform Fiesta Travel Ltd. or the relevant tour operator or service provider immediately. Fiesta Travel Ltd. is entitled to receive payment for the booked service on behalf of or on the instructions of the tour operator or service provider. On your part, you authorise us, upon conclusion of the agency contract, to debit your credit card with the amount of the remuneration. The travel documents will be sent to you directly by the tour operator or service provider or through our service centre by post, courier or email. service provider or by our service centre by post, courier or email. Please note that for cancellations of scheduled flights arranged by us and airline tickets already issued through Fiesta-fly.com, a flight cancellation fee will be charged at the rate set by the travel agent. This fee is not related to any possible cancellation fees charged by the airlines, which are payable separately in accordance with their General Terms and Conditions and cancellation fees for reservations and tickets already issued.
    4. Insurance. The cost of insurance for the services provided is not included in the prices listed on the website, unless expressly agreed otherwise. We recommend that you take out travel insurance, as well as travel cancellation insurance and/or health insurance through the tour operator or the relevant service provider. The insurance contract is not governed by these General Terms and Conditions and is subject to the General Terms and Conditions of the insurer, tour operator or relevant service provider through whom the insurance was taken out.
    5. Passport, visa, currency and health requirements. The recommendations given for passport, visa, currency and health requirements relating to your trip are not binding. You should make sure in a suitable way how much they apply to you and what you should do based on your citizenship and the visa and passport rules of the country you're visiting. For such and similar questions, please contact the relevant embassies and consulates for more information. The recommendations of Fiesta Travel Ltd. are based on information and data provided by the relevant countries or official authorities. They, in turn, may change the relevant provisions at any time, for which Fiesta Travel Ltd. is not responsible for the accuracy, completeness or timeliness of this information.
    6. Limitation of liability. With regard to travel data and individual services, Fiesta Travel Ltd., through Fiesta-fly.com, relies on the information received from the relevant tour operators or service providers. Fiesta Travel Ltd., through Fiesta-fly.com, is unable to verify the accuracy of this information at the time of the customer's enquiry. Fiesta Travel Ltd., through Fiesta-fly.com, therefore does not guarantee the completeness, accuracy or timeliness of this information. The same applies to other information contained on the Fiesta-fly.com website and provided by third parties. No responsibility is taken for the availability of the trip or individual service at the time of booking. The services offered are provided by the service providers at their own responsibility. Therefore, Fiesta Travel Ltd. is not responsible for the performance of the agreed trip or individual service. The responsibility for this remains solely with the tour operator or service provider.
    7. Guarantees on the part of the Customer. By submitting the booking request, you declare your agreement to any use of this website on your behalf and at your expense. If the booking concerns minors from your household or family, this must be observed by you and you are responsible for any use of the website by you and them. No booking can be made if you provide incorrect or incomplete personal data. You agree that the travel booking options on this website may only be used for lawful bookings or purchases for yourself or a third party on whose behalf you are legally authorised to act.In the event of a breach of these guarantees on your part, you shall be liable to Fiesta Travel Ltd. and the relevant tour operators and service providers for any damages and lost profits arising from your actions or those of your minor children.
    8. Change of reservation/cancellation In case of change or cancellation of the reservation of the tourist services offered by Fiesta Travel Ltd. through Fiesta-fly.com, please contact our service centre. In case of a change or cancellation of a reservation, the general terms and conditions and rates of the respective tour operators or service providers shall apply. Fiesta Travel Ltd. cannot change or replace their General Terms and Conditions and rates, and in this sense, any liability on our part is excluded. You can find out about the conditions for changing or cancelling a booking, as well as the rules for compensation in the event of unforeseen circumstances, at any time in your travel plan through us, the tour operator or the service provider.

    9. Rules in English/German. We would like to point out that Fiesta-fly.com mainly contains offers that are fed directly from international computer reservation systems. Fiesta Travel Ltd. has no influence whatsoever on these rules and offers. These offers may contain rules in English or German that may affect the type and scope of the service offered. If, during the booking process, you decide to accept the rules and terms and conditions in English or German (Terms and Conditions/AGB), they will apply to you.

       

  3. Terms and conditions for the general use of the Fiesta-fly.com website.
    1. General provisions. By using Fiesta-fly.com, you accept all rules, terms and conditions.
    2. Links to other websites. Fiesta-fly.com contains links to other external websites that are maintained by other contractual parties/partners. Such links are provided for informational purposes only.Fiesta Travel Ltd., through Fiesta-fly.com, cannot control these third-party websites and is not responsible for their content. The inclusion of hyperlinks to such websites by Fiesta-fly.com does not imply any approval of the content of such websites or any connection with their operators. Fiesta Travel Ltd., through Fiesta-fly.com, is not responsible for external websites and any damage arising from their use.
    3. Possibility of technical use of Fiesta-fly.com Fiesta Travel Ltd. does not guarantee the possibility of continuous technical use of Fiesta-fly.com. The inability to use Fiesta-fly.com for technical reasons does not constitute grounds for claims for compensation from the customer.

    4. Copyright The selection, software, products and information are based either on Fiesta Travel Ltd.'s own research/programming via Fiesta-fly.com and/or on relevant data/deliveries from third parties, i.e. the relevant service providers and data providers. All data, products, software, images, illustrations and information that you receive through this website are protected by copyright and other intellectual property rights. Therefore, you may not modify, copy, distribute, transfer, display, demonstrate, reproduce, republish, license, create derivative works from, or transmit or sell them.Without the express written consent of the owner, changing the data and information, as well as using them on other websites and for purposes other than personal, non-commercial purposes, is a violation of copyright law and related rights. In case of copyright infringement, Fiesta Travel Ltd. or the holder of the relevant right may seek criminal and/or civil liability in accordance with the relevant procedure and/or through the competent court.

       

  4. Final terms and conditions.
    1. Changes to the terms and conditions of use Fiesta Travel Ltd., through Fiesta-fly.com, reserves the right to change the terms and conditions under which this website offers travel and transport services in relation to future intermediary contracts. However, this right does not affect existing agency contracts that you have concluded through Fiesta-fly.com, in accordance with the existing terms and conditions.
    2. Violation of the General Terms and Conditions In case of violation of these terms of use or reasonable suspicion of violation or intent to abuse, Fiesta Travel Ltd. through Fiesta-fly.com has the right to exclude and deprive the respective user of use at any time and to seek liability from them.
    3. Applicable law and jurisdiction Bulgarian law shall apply to the mediation of Fiesta Travel Ltd. through Fiesta-fly.com and the relations with the customer. The place of jurisdiction for any legal disputes shall be the competent court in Sofia, unless otherwise provided by mandatory provisions of law.     4. Limitation of invalidity If one of the above conditions is or becomes invalid, its invalidity shall not affect the remaining conditions. The invalid condition shall be replaced by a condition that comes closest to the economic purpose of the condition to be replaced. These General Terms and Conditions for Working with Customers of Fiesta Travel Ltd. supersede all previous ones and are effective as of 01.05.2009.
