GENERAL TERMS AND CONDITIONS AND CLIENT OPERATING RULES OF FIESTA TRAVEL EOOD
General Provisions
Fiesta Travel EOOD is a travel agency that offers and maintains travel, information, communication, and reservation systems for tourism services on the Internet, which contain offers, information, and services related to travel. FiestaTravel.bg is a franchise brand of Fiesta Travel EOOD. For matters not addressed in the contractual relationship between Fiesta Travel EOOD and the client, these General Terms and Conditions and Client Operating Rules apply. Any different or supplementary General Terms and Conditions will only apply after explicit written confirmation from Fiesta Travel EOOD. The following commercial general conditions and client operating rules govern the use of the portal FiestaTravel.bg, owned by Fiesta Travel EOOD.
- Conditions for Booking Travel Services through FiestaTravel.bg.
Services of Fiesta Travel EOOD Offered Through the FiestaTravel.bg Portal
The travel and transport services offered by Fiesta Travel EOOD through the FiestaTravel.bg portal are intermediary services, provided on behalf of, at the expense of, and at the request of the respective tour operator and/or service provider. The actual provision of the travel and transport services is not part of the services provided through FiestaTravel.bg. Unless otherwise agreed between Fiesta Travel EOOD and the client, the contract for accommodation, travel, or transportation is concluded between the client and the respective service provider (e.g., tour operator, hotel, airline, etc.), with the valid terms and conditions being taken into account. These conditions are announced before booking and must be confirmed by you. Without such confirmation, the reservation cannot be made.
Content of the Mediation Agreement
Upon completion of the booking process, after filling out the form fields, you authorize Fiesta Travel EOOD through FiestaTravel.bg to act as an intermediary for a tourism, transportation, or other similar service, as well as a service related to the travel provided by a third party. If the client orders mediation for more services, they remain legally separate and do not form a single set of travel services. Fiesta Travel EOOD remains solely an intermediary and does not assume the role of a tour operator.
With your booking request, you commit yourself from the moment of submission. Fiesta Travel EOOD through FiestaTravel.bg reserves the right to accept or reject this order. The acceptance or rejection of the booking by Fiesta Travel EOOD will be confirmed within one week - in writing, by phone, email, or fax. Acceptance of your order by Fiesta Travel EOOD is considered when your credit card is charged or when a voucher is presented from Fiesta Travel EOOD or the respective service provider. By accepting your order in the specified manner, a binding intermediary agreement is concluded between the travel agent and the client.
You are obliged to immediately check the reservation confirmation for accuracy and notify Fiesta Travel EOOD or the respective service provider of any errors. A late notification of errors or inaccuracies cannot be considered and does not give the right to cancel the contract.
The contractual obligation of Fiesta Travel EOOD through FiestaTravel.bg is limited to mediating the booked trip or travel service. The actual provision of the reserved service is not part of Fiesta Travel EOOD's contractual obligations.
Implementation of Your Reservation / Compensation / Payment / Delivery of Travel Documentation
• Online Reservation
The mediation of tourist or transport services by Fiesta Travel EOOD through Fiesta travel.bg is free, unless it concerns the mediation of airline flights. For the mediation of flights, Fiesta Travel EOOD reserves the right to charge a separate service fee. The respective amount for this fee will be communicated in the reservation menu before requesting personal data and before an obligation to make a reservation. By agreeing to this, you declare that you voluntarily provide the necessary personal data for making the reservation and providing the service.
The payment method for the tourist or transport services reserved through Fiesta travel.bg is determined according to the arrangements with the relevant tour operator or service provider. The available payment options will be communicated to you during the reservation process. Depending on the travel date, payment can be made via credit card, bank transfer, or in cash.
If you change your credit institution or any other details of your credit card between the reservation and the beginning of the trip, you are required to inform Fiesta Travel EOOD or the relevant tour operator or service provider immediately.
Fiesta Travel EOOD has the right, on behalf or at the request of the tour operator or service provider, to collect payment for the reserved service. By placing your order, you authorize us to charge your credit card for the payment.
The travel documents will be sent to you directly from the tour operator, service provider, or through our service center by mail, courier, or email.
Please note that a cancellation fee is due for regular flights and tickets already issued through Fiesta travel.bg. This fee is determined by the travel agency and is separate from any cancellation fees charged by airlines, which are applied according to their terms and conditions and cancellation policies.
Insurance.
The cost of insurance related to the provided services is not included in the prices published on the website, unless otherwise specifically agreed. We recommend that you take out travel insurance, as well as insurance for trip cancellation and/or health insurance through the tour operator or the respective service provider. The insurance contract is not regulated by these General Terms and Conditions and is governed by the General Terms and Conditions of the insurer, tour operator, or the respective service provider through whom the insurance is concluded.
Passport, visa, currency, and health requirements.
The recommendations regarding passport, visa, currency, and health requirements related to your trip are not binding. You should verify further in an appropriate manner whether they apply to you and what actions are required based on your nationality and the specific visa and passport regulations of the country you are visiting. For such matters, you should contact the competent embassies and consulates for more information. Regarding the recommendations of Fiesta Travel EOOD, they are based on information provided by the relevant countries or official authorities. These authorities can change the applicable regulations at any time, and Fiesta Travel EOOD is not responsible for the accuracy, completeness, or timeliness of this information.
Limitation of liability.
With regard to travel data and individual services, Fiesta Travel Ltd. through Fiesta travel.bg relies on information received from the respective tour operators or service providers. Fiesta Travel Ltd. through Fiesta travel.bg has no ability to verify the accuracy of this data at the time of the customer's inquiry. For this reason, Fiesta Travel Ltd. through Fiesta travel.bg does not assume responsibility for the completeness, accuracy, or timeliness of this information. The same applies to other information contained on the electronic portal Fiesta travel.bg and provided by third parties. No responsibility is assumed for the availability of the trip or individual service at the time the reservation is made.
The proposed services are provided by the service providers at their own risk. Therefore, Fiesta Travel Ltd. is not responsible for the execution of the agreed trip or individual service. The responsibility for this remains solely with the tour operator, respectively the service provider.
Customer obligations.
By submitting the booking order, you declare your agreement with any use of this website on your behalf and at your expense. In case the booking concerns minors or underage individuals from your household or family, this must be supervised by you, and you are responsible for any use of the website by you and them. A booking cannot be made if you provide incorrect or incomplete personal data. You declare your agreement that the booking options for travel on this website may only be used for lawful bookings or purchases for yourself or a third party, on whose behalf you are authorized to take lawful actions.
In case of a breach of these warranties by you, you are fully liable to Fiesta Travel Ltd. and to the respective tour operators and service providers for any damages and lost profits resulting from your actions or those of your minor and underage children under your care.
Booking change/cancellation
In case of a change or cancellation of a booking for the services offered by Fiesta Travel Ltd. through Fiesta travel.bg, you should contact our customer service center. In case of a booking change or cancellation, the general terms and conditions and tariffs of the respective tour operators or service providers apply. Fiesta Travel Ltd. cannot modify or replace their General Terms and Conditions and tariffs, and in this regard, any responsibility on our part is excluded. You can always find out about the conditions for changing or canceling a booking, as well as the rules for compensation in case of unforeseen circumstances, through your travel plan with us, the tour operator, or the service provider.
Rules in English/German
We would like to point out that Fiesta travel.bg primarily contains offers directly sourced from international booking computer systems. Fiesta Travel Ltd. has no influence over these rules and offers. These offers may contain rules in English or German, which may affect the type and scope of the offered service. In case you decide to accept the rules and terms and conditions in English or German (Terms and Conditions/AGB) during the booking process, they will apply to you.

Therefore, you are not allowed to alter, copy, distribute, transfer, display, demonstrate, reproduce, republish, license, create derivative works, or transmit and sell them.

Modification of the terms of use.
Fiesta Travel Ltd. through Fiesta travel.bg reserves the right to modify the terms and instructions under which this website offers travel and transportation services in relation to future intermediary contracts. However, this right does not affect already existing intermediary contracts that you have entered into through Fiesta travel.bg, legally approved under the existing terms.
Violation of the General Terms and Conditions.
In case of violation of these terms of use or reasonable suspicion of a violation or intent to abuse, Fiesta Travel Ltd. through Fiesta travel.bg has the right to exclude and deny access to the respective user at any time, and seek responsibility from them.
Applicable law and jurisdiction.
With regard to the mediation of Fiesta Travel Ltd. through Fiesta travel.bg and the relationship with the client, Bulgarian law applies. The competent court in Sofia is the place for resolving legal disputes, unless otherwise stipulated by mandatory provisions of the law. For the relationship between the client and the tour operators or service providers, the law of the latter applies, unless otherwise stipulated by mandatory provisions of the law.
Limitation of invalidity.
If any of the previous conditions is or becomes invalid, its invalidity does not affect the remaining conditions. The invalid condition will be replaced by a condition that is closest to the economic purpose of the condition to be replaced. These General Terms and Conditions and the customer service rules of Fiesta Travel Ltd. cancel all previous ones and are effective as of May 1, 2009.
